Tandym Design provides custom website design and related services, including subscription-based design and support, as well as one-time project builds. Details of your selected plan or project scope will be provided during onboarding and reflected in your invoice or contract.

 

2. Subscription Terms

• Subscription billing occurs monthly unless otherwise agreed upon.

• Startup fees are billed once and are non-refundable once work has begun.

• Subscriptions include a defined number of support or edit hours per month, which do not roll over.

• Clients may cancel their subscription at any time with 14 days’ written notice. Cancellation halts further billing but does not refund past charges.

 

3. Payment & Invoicing

• All payments are processed through a secure third-party provider (e.g., Stripe).

• Subscription fees are automatically billed each month on the date of activation.

• Late or failed payments may result in a pause of services until resolved.

• One-time project payments may follow a milestone schedule or upfront billing model, depending on the scope.

4. Ownership & Access

• All content and designs created by Tandym remain the property of Tandym Design unless a separate buyout is agreed upon in writing.

• You retain ownership of your logo, text, and media assets that you provide.

• If a subscription is canceled, we will retain the website unless a transfer or buyout agreement has been completed.

5. Client Responsibilities

Clients agree to:

• Provide timely feedback, content, and approvals to avoid delays

• Ensure that all content submitted is legal, original, or properly licensed

• Not use the website or services for any unlawful or harmful activity

6. Limitation of Liability

Tandym Design is not liable for any indirect, incidental, or consequential damages resulting from the use of your website, delays in launch, or service interruptions. We do not guarantee specific business outcomes or site traffic.

7. Modifications to Services

We reserve the right to update or modify our service offerings, pricing, or these Terms. We will notify active clients of any significant changes.

8. Governing Law

These Terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the appropriate courts of Cuyahoga County, OH.
